Conducting Investigation and Domestic Inquiry

Workplace misconduct, if not addressed with the right approach, can undermine trust, productivity, and legal compliance. To manage such situations effectively, employers must be equipped with the right skills to conduct fair and thorough investigations, followed, when necessary, by a properly executed domestic inquiry.
Participants will learn how to conduct thorough workplace investigations to establish a prima facie case, assess its strength, and determine the appropriate course of action, whether administrative, disciplinary, or otherwise. The program also explores methods for handling cases that may involve potential criminal elements. The Domestic Inquiry process, a critical component of effective disciplinary
management, focuses on the procedural knowledge and professional mindset required to conduct inquiries that are both fair and legally compliant. The training emphasizes the specific roles and responsibilities of the Chairman, Panel Members, and Prosecuting Officer, while reinforcing the fundamental importance of upholding the principles of natural justice at every stage of the inquiry.
This program combines real case examples, Industrial Court decisions, and key legal principles to help participants confidently and fairly manage workplace misconduct cases in line with Malaysian labour laws and disciplinary procedures.
